One of the most distinctive features of airline operations conducted under 14 CFR Part 121 is the concept of joint responsibility. Unlike a private pilot who acts alone in deciding whether and how to fly, the captain of a domestic or flag air carrier flight shares authority — and accountability — with a certificated aircraft dispatcher on the ground. This relationship is not informal; it is codified in federal regulation and defines the legal framework within which every dispatch release is issued and every flight is conducted.
Understanding joint responsibility is essential for the Aircraft Dispatcher written exam, the oral examination, and day-to-day professional practice. It answers the fundamental question: who is in charge? The answer, perhaps surprisingly, is: both — in different but complementary ways.
The Regulatory Foundation: 14 CFR 121.533
Section 121.533 is the cornerstone of this topic. It establishes a two-tier structure of authority and responsibility. At the operational control level, the certificate holder (the airline) exercises control through two agents simultaneously: the pilot in command and the aircraft dispatcher. The regulation makes clear that neither party operates in isolation. Both must agree — through the dispatch release — before a domestic or flag operation can legally depart.
The section specifically states that the pilot in command is responsible for the safe operation of the aircraft during flight time. This means once the aircraft is airborne, the PIC has ultimate authority over all decisions related to the safety of the flight. No one on the ground — not even the dispatcher — can override the captain's judgment about what must be done to protect persons and property aboard the aircraft.
At the same time, the aircraft dispatcher is jointly responsible with the PIC for the preflight planning, the dispatch release itself, and the initiation of the flight. Before the flight ever leaves the gate, the dispatcher's role is co-equal. The dispatcher must be satisfied that the flight can be conducted safely given weather, NOTAMs, NOTAM information, aircraft condition, alternate airport requirements, fuel, and all other relevant factors. If the dispatcher cannot make that determination, the flight must not be released.
How Joint Responsibility Works in Practice
Think of the relationship as a two-key system. The dispatcher holds one key and the pilot holds the other. Both keys must turn — both parties must concur — before the flight can be legally initiated. This plays out across several specific duties:
- Dispatch release agreement: The dispatcher prepares the dispatch release. The PIC reviews and signs it, indicating agreement that the flight can be conducted safely. Neither signature alone is sufficient; both are required by 14 CFR 121.663 before departure.
- Authority to delay or cancel: Either the PIC or the dispatcher may independently delay, divert, or cancel a flight if they believe conditions are unsafe. This authority is equal and unilateral — one person's refusal is enough to stop the flight, regardless of pressure from the other party or from company management.
- Inflight authority: Once the flight is underway, the PIC has final authority over the operation of the aircraft. However, the dispatcher continues to exercise operational control by monitoring the flight, providing updated weather and NOTAM information, and recommending changes to the flight plan when conditions warrant. If the dispatcher receives information suggesting the flight is in danger, the dispatcher must notify the PIC.
- Dispatcher's duty to communicate: Under 14 CFR 121.601, the dispatcher is required to provide the flight crew with all available information that may affect the safety of the flight. This ongoing communication duty is part of the joint responsibility framework even after departure.
The Dispatcher's Unique Authority: Releasing and Restricting Flights
A dispatcher's authority goes beyond simply agreeing to a release. The dispatcher may issue a dispatch release with restrictions, such as requiring the flight to remain at or below a certain altitude, to land at an intermediate stop, or to avoid a specific route segment due to weather. The PIC may accept or negotiate those restrictions, but may not unilaterally remove them without concurrence from the dispatcher.
Conversely, the dispatcher may amend a dispatch release inflight when new information — for example, a destination airport unexpectedly going below minimums — makes the original release conditions no longer valid. In that case, the dispatcher must communicate the new information and work with the PIC to determine an alternative course of action. The dispatcher cannot force the PIC to take a specific action that the PIC believes is unsafe; but the PIC cannot simply ignore a dispatcher's advisory and proceed as if nothing has changed.
Why This System Exists: The Safety Rationale
The joint responsibility system exists because no single individual has complete situational awareness. The PIC is inside the aircraft, managing crew, passengers, and systems, potentially in IMC or turbulence, with limited access to the broad meteorological and operational picture. The dispatcher is on the ground with access to real-time weather radar, PIREP databases, SIGMETS, company maintenance records, ATC ground delay programs, and the ability to coordinate across multiple flights simultaneously.
By requiring both parties to agree before a flight departs — and by keeping the dispatcher actively engaged throughout — the system creates a redundant safety check. An impaired, fatigued, or pressured PIC cannot unilaterally launch into dangerous conditions without a dispatcher also signing off. A desk-bound dispatcher cannot compel a crew to fly into conditions the crew considers unsafe. The regulation deliberately distributes authority to prevent either party from being overridden by organizational pressure alone.
Supplemental Operations: A Different Standard
It is important to note that the joint responsibility framework of 14 CFR 121.533 applies specifically to domestic and flag operations. Supplemental operations under Part 121 follow a substantially similar joint responsibility model described in 14 CFR 121.535, where the PIC and aircraft dispatcher are jointly responsible for the preflight release and initiation of the flight, much as under 121.533. The key distinction is not domestic/flag versus supplemental, but whether the operation uses a dispatch release system with a dispatcher (121.535) or, in certain supplemental operations, a flight locating system without a dispatcher (121.537), which reflects the historically different nature of some supplemental (charter-style) operations.
Dispatcher candidates must know both models — and, critically, must know which regulations apply to which operation type. Confusing the joint responsibility structure of 121.533/121.535 with the flight-locating procedures of 121.537 (which do not require a dispatcher) is a common exam error.

- Thinking the dispatcher's role ends at departure: The dispatcher continues to monitor, communicate, and amend the release inflight. The joint relationship is ongoing, not just a preflight checkbox.
- Forgetting that both signatures are legally required: A flight that departs without both the PIC and dispatcher concurring on the release is not in compliance with Part 121, regardless of whether conditions were actually safe.
