Alcohol and aviation are a dangerous combination that kills pilots every year. To protect everyone in the sky, the FAA established strict rules governing when a pilot may act as pilot in command (PIC) or as a required crew member after consuming alcohol. These rules appear in 14 CFR 91.17 and carry serious certificate consequences for violations — yet the regulations are also frequently misunderstood. Understanding all three prongs of the rule, plus the physiological reasons behind them, is essential both for the FAA knowledge test and for your safety throughout your flying career.
The core principle is straightforward: alcohol impairs the very faculties — judgment, reaction time, spatial orientation, and vision — that pilots depend on most. Even modest amounts of alcohol affect night vision and the vestibular system long before a pilot feels obviously intoxicated. The FAA's rules are designed with wide safety margins for good reason.
The Three-Prong Rule Under 14 CFR 91.17
The regulation prohibits any person from acting as a crew member of a civil aircraft under three distinct and independent conditions. You must avoid all three, not just the one you happen to remember:
- Within 8 hours of consuming any alcoholic beverage — This is the famous "bottle-to-throttle" rule. Eight hours must pass between your last drink and the moment you take the controls. Note that this is a minimum floor, not a safe ceiling.
- While under the influence of alcohol — Even if 8 hours have passed, you may not fly if alcohol is still affecting your performance. Blood alcohol can remain elevated longer than 8 hours depending on how much was consumed, body weight, metabolism, and food intake.
- With a blood alcohol concentration (BAC) of 0.04% or greater — This is a hard numerical limit. The automobile legal limit in the United States is 0.08%, so the FAA's aviation limit is exactly half of that. A BAC at or above 0.04% is a per se violation — you are prohibited regardless of how you feel or how functional you believe yourself to be.
It is critical to understand that these three conditions are independent. Satisfying one does not excuse a violation of another. A pilot who waited 8 hours but still has a BAC of 0.04% is in violation. A pilot whose BAC is below 0.04% but who is noticeably impaired is also in violation. All three prongs must be clear before you can legally act as a crew member.
What "Under the Influence" Really Means
The phrase "under the influence" is broader than many pilots realize. It does not require obvious intoxication or slurred speech. The FAA interprets this to mean any impairment of faculties that would reduce a pilot's ability to operate an aircraft safely. This includes subtle effects: slower reaction time, degraded decision-making, reduced ability to divide attention across multiple tasks, and impaired night vision. Research consistently shows these effects begin at BAC levels well below 0.04%. This is one reason the FAA strongly discourages flying at all within 24 hours of consuming alcohol — a guideline often referred to informally as the "24-hour rule," though only the 8-hour minimum is legally mandated.
The vestibular system is particularly vulnerable to alcohol. Even after BAC returns to zero, alcohol can remain in the fluid of the semicircular canals, causing a phenomenon called the "Coriolis illusion" or alcohol-induced positional nystagmus. This can produce dangerous spatial disorientation in actual instrument meteorological conditions (IMC) or at night, even when a pilot feels sober.
The BAC Limit in Context
The 0.04% BAC ceiling is strict by design. At this level — and even below it — research demonstrates measurable degradation in pilot performance on simulation tasks requiring tracking, multi-tasking, and instrument scan. Compared to the 0.08% limit that applies in most U.S. states for automobile driving, the aviation standard reflects the much greater consequences of impairment at altitude, where there is no roadside guardrail and no way to simply pull over.
It is also worth noting that altitude itself amplifies the effects of alcohol. At higher cabin altitudes, the reduced partial pressure of oxygen means the brain is already receiving slightly less oxygen than at sea level. Alcohol compounds hypoxic effects, so a given BAC will impair a pilot more at altitude than on the ground. The FAA's Pilot's Handbook of Aeronautical Knowledge (PHAK) notes that the effects of one drink at altitude can equal the effects of two or three drinks at sea level, depending on the altitude and individual physiology.
Drug Prohibitions Under the Same Regulation
14 CFR 91.17 also prohibits flying while using any drug that affects the person's faculties in any way contrary to safety. This includes both illegal substances and legal medications — prescription drugs, over-the-counter antihistamines, sedatives, and other medications that cause drowsiness, dizziness, or cognitive impairment. The phrase "any drug" is intentionally broad. While drug use is a separate topic from alcohol, it falls under the same regulatory section and carries the same enforcement consequences.
Enforcement and Certificate Consequences
Violations of 14 CFR 91.17 can result in certificate suspension or revocation. Additionally, a separate provision — 14 CFR 61.15 — requires pilots to report any motor vehicle action (MVA) related to alcohol or drugs within 60 days to the FAA Civil Aviation Registry. This includes DUI convictions, DWI convictions, refusals to submit to BAC testing, and other alcohol-related traffic offenses. Failure to report is itself an independent grounds for certificate action, separate from the underlying offense. The FAA also receives records from the National Driver Register and can discover unreported MVAs through routine medical certificate reviews.
Law enforcement officers may request a BAC test from a pilot suspected of violating 91.17, and refusing to take a test can itself be grounds for certificate action in some circumstances. The consequences are serious and long-lasting — an alcohol-related violation on your record affects not just your pilot certificate but potentially your medical certificate and any future employment in aviation.

Common Test Traps
- Treating 8 hours as a guarantee of safety. The FAA knowledge test sometimes presents scenarios where 8 hours have passed but the pilot consumed a very large amount of alcohol. The correct answer is that the pilot may still be in violation of the "under the influence" prong or the 0.04% BAC limit. All three prongs apply independently.
- Confusing 0.04% with 0.08%. Test questions may include 0.08% as a distractor. Remember: the aviation limit is 0.04%, half the common automotive threshold.
- Forgetting the reporting requirement. Students often focus only on 91.17 and forget that 14 CFR 61.15 requires reporting alcohol-related motor vehicle actions within 60 days — failure to report is a separate violation.
- Assuming legal drugs are always safe to fly on. The regulation prohibits any drug affecting faculties contrary to safety — legal status of the substance is irrelevant. Over-the-counter cold medicine can be just as disqualifying as an illegal drug if it impairs performance.
- Ignoring altitude's amplifying effect on alcohol. A test question may ask about the physiological effects of alcohol at altitude. The correct concept is that altitude (and accompanying mild hypoxia) intensifies the impairing effects of alcohol beyond what they would be at sea level.
