Declaring an emergency with ATC gives a pilot priority handling and immediate resources; knowing when and how to declare—and the regulations behind it—can save lives.

No moment in a student pilot's training feels more charged than learning about emergencies. There is a common fear that declaring an emergency with Air Traffic Control (ATC) will trigger mountains of paperwork, an FAA investigation, or even certificate action. That fear is unfounded, and allowing it to delay a declaration can be fatal. Understanding exactly what an emergency declaration is, how to execute one correctly, and what the regulations actually say will make you a safer, more confident pilot from your very first solo flight onward.

An emergency declaration is simply a pilot's formal notification to ATC that an aircraft is in distress or urgency. It activates a powerful system of priority services: immediate clearances, dedicated frequency monitoring, coordination with rescue services, and the full attention of every controller who can help. The system exists for you. Use it.

The Two Levels of Distress

The FAA and the International Civil Aviation Organization (ICAO) recognize two distinct levels of emergency, and the distinction matters both operationally and on your knowledge test.

  • Distress — A condition of being threatened by serious and/or imminent danger requiring immediate assistance. Think engine failure, fire on board, or a medical incapacitation. The distress call uses the word MAYDAY, spoken three times: "Mayday, Mayday, Mayday."
  • Urgency — A condition concerning the safety of an aircraft or its occupants, but one that does not yet require immediate assistance. Examples include a fuel state that is becoming critical, an instrument that is behaving abnormally, or a pilot who is uncertain of position. The urgency call uses the phrase PAN-PAN, spoken three times: "Pan-Pan, Pan-Pan, Pan-Pan."

Both levels entitle the pilot to priority handling from ATC. The choice of word signals how urgently controllers must respond. When in doubt, always escalate — it is far better to declare a MAYDAY and not need it than to declare a PAN-PAN when seconds count.

How to Declare: The Mechanics of the Call

In a genuine emergency, you want to get help as fast as possible. The Aeronautical Information Manual (AIM), Section 6-3-1, recommends a structured emergency call that gives ATC the critical facts quickly. A complete distress or urgency message includes the following elements, in this order:

  1. The distress or urgency signal — "Mayday, Mayday, Mayday" or "Pan-Pan, Pan-Pan, Pan-Pan"
  2. Your aircraft identification and type — Your full call sign and aircraft type, e.g., "Cessna 4572 Romeo, Cessna 172"
  3. The nature of the emergency — Engine failure, fuel exhaustion, pilot incapacitation, etc.
  4. Weather — Relevant weather conditions, if known
  5. Your intentions — What you plan to do: land at the nearest airport, divert, orbit, etc.
  6. Your present position and heading — GPS coordinates, bearing and distance from a VOR or fix, or a visual landmark, plus your heading (or last known position and heading)
  7. Altitude
  8. Fuel remaining — In minutes
  9. Number of persons on board
  10. Any other useful information — Such as pilot qualifications, if time and circumstances allow

In a severe emergency you may not have time to transmit everything. That is perfectly fine. Transmit what you can, when you can. Even a single "Mayday" on any frequency begins the rescue process. Do not let the desire for a perfect radio call delay your transmission.

Which Frequency to Use

The dedicated emergency frequency is 121.5 MHz, known as "Guard." This frequency is monitored by many ATC facilities and by military and civilian search-and-rescue assets, though coverage is not universal and varies by facility and equipment. If you are already in contact with ATC on an assigned frequency, declare your emergency on that frequency — the controller is already working your flight and has your data. Switching to 121.5 is appropriate if you cannot reach anyone on your current frequency, if you are out of radio contact, or if you are operating in uncontrolled airspace with no current ATC contact.

Transponder code 7700 is the universal emergency squawk. Setting 7700 will trigger an alert on every radar display painting your aircraft, immediately drawing attention even if you cannot transmit verbally. If you have lost all radio capability but still have electrical power, squawking 7700 is one of the most important actions you can take. Note the additional codes: 7600 for lost communications (NORDO) and 7500 for hijacking. On your knowledge test, these three codes are among the most frequently tested items.

The Regulations: What the FAA Actually Says

The legal foundation for emergency action is found in 14 CFR Part 91.3, "Responsibility and Authority of the Pilot in Command." Section 91.3(b) is unambiguous: In an in-flight emergency requiring immediate action, the pilot in command may deviate from any rule of this part to the extent necessary to meet that emergency. This is a sweeping grant of authority. You may deviate from altitude assignments, airspace restrictions, VFR weather minimums, fuel reserve requirements — virtually any operating rule — if the emergency genuinely requires it.

Section 91.3(b) also requires that, upon request from the FAA, a pilot who deviates must send a written report of the deviation. This is the source of the "paperwork" concern most students have. In practice, this report is not punitive in nature; it is informational, and the FAA uses it to understand what happened. Controllers may ask you to file an irregularity report, but a sincere emergency declaration made in good faith virtually never results in certificate action. The FAA's primary concern is whether the pilot exercised sound judgment in declaring the emergency — and the guidance is consistently that pilots should declare early.

It is also worth noting that 14 CFR 91.183 requires IFR pilots who deviate from an ATC clearance in an emergency to notify ATC as soon as possible. The principle is the same under VFR: communicate early and often.

Why It Matters: The Real-World Case for Early Declaration

Accident reports studied by the NTSB consistently reveal a troubling pattern: pilots in deteriorating situations wait far too long to declare. They troubleshoot alone, hoping the problem resolves itself. They worry about embarrassment. By the time they call for help, options have narrowed fatally.

Declaring early does the opposite — it opens options. ATC can immediately begin coordinating with approach control at the nearest airport, alerting crash-fire-rescue (CFR) services, clearing traffic from your path, and providing radar vectors. None of this can happen until you make the call. Every minute of delay is a minute during which help is not yet organized.

Consider a simple scenario: your engine begins running rough some distance from the nearest airport. If you declare immediately, ATC can begin setting up the airport for your arrival while you still have altitude and energy to work with. If you instead spend precious minutes troubleshooting alone before calling, you narrow your own options and delay the help that could have already been in motion. (This is illustrative, not an FAA-published figure — the point to remember for the test is simply that earlier notification always preserves more options.)

The AIM (6-3-1) lays out the recommended content of a distress or urgency message in a specific order: identification and aircraft type, nature of the emergency, weather, your intentions, position and heading, altitude, fuel remaining in minutes, and number of persons on board. Learning that order — rather than an invented acronym — is the most reliable way to prepare for both a real emergency and a knowledge-test question on the subject.

Prepend the sequence with your Mayday or Pan-Pan call and your call sign, and you have a complete, actionable transmission.

Common Test Traps

  • Confusing Mayday and Pan-Pan — The exam will present scenarios and ask which signal applies. Remember: Mayday = immediate danger to life; Pan-Pan = serious but not yet life-threatening.
  • Thinking 7700 replaces a radio call — Squawking 7700 is critical but does not substitute for verbal communication. You must attempt a radio call as well.
  • Misidentifying 7600 as the emergency code — 7600 is lost communications (NORDO), not the general emergency code. The test exploits the similarity between 7600 and 7700.
  • Believing an emergency declaration requires ATC permission — The pilot in command declares; no clearance or permission from ATC is needed. 14 CFR 91.3 places full authority and responsibility with the PIC.
  • Assuming a written report is automatic or punitive — The report is only required if the FAA requests it, and it is investigative, not automatically disciplinary. Good-faith emergency declarations made in genuine distress are not the basis for certificate action.
